Sexual violence, apart from being a dehumanising act, is an unlawful intrusion on the right of privacy and sanctity of a woman. It is a serious blow to her supreme honour and offends her self-esteem and dignity as well. It degrades and humiliates the victim and where the victim is a helpless innocent child or a minor, it leaves being a traumatic experience. Child rape cases are cases of perverse lust for sex even innocent children are not spared in pursuit of sexual pleasure. There cannot be anything more obscene than this. It is a crime against humanity. Many such cases are not even brought to light because of the social stigma attached thereto.
The Protection of Children from Sexual Offences Act, 2012 was enacted by the Parliament, an Act to protect children from offences of sexual assault, sexual harassment and pornography and provide for establishment of Special Courts for trial of such offences and for matters connected therewith or incidental thereto. The Protection of Children from Sexual Offences Act is gender-neutral and it does not discriminate or distinguish between a boy and a girl, as victim of sexual offences.
