Overview:

The Occupational Safety, Health and Working Conditions Code, 2020 is one of the four labour codes that recast Indian labour law, and it is the one that reaches furthest into the daily running of a workplace. This volume presents the Code section-wise, explaining how it subsumes thirteen central enactments - among them the Factories Act, 1948, the Mines Act, 1952, the Contract Labour (Regulation and Abolition) Act, 1970, the Inter-State Migrant Workmen Act, 1979, the Building and Other Construction Workers Act, 1996, the Plantations Labour Act, 1951 and the Motor Transport Workers Act, 1961 - into a single framework for registration of establishments, the duties of employers and of employees, and the machinery of Inspectors-cum-Facilitators.

The commentary covers the substantive obligations the Code imposes: appointment letters and annual health examinations, occupational safety and health standards and the National and State Occupational Safety and Health Advisory Boards, welfare facilities, hours of work, weekly rest, overtime and annual leave with wages, together with the restrictions on the employment of women and young persons. Separate treatment is given to the special provisions for factories, mines and docks, for building and other construction work, for plantations, for contract labour and inter-state migrant workers, and for audio-visual workers, journalists and sales promotion employees, followed by the provisions on offences, penalties and compounding.
