The legal aspects of pregnancy have been studied along with law relating to delivery in general and that pertaining to caesarean section in particular. The law relating to abortion has been discussed in the Indian context and the current change in the law. Till recently, abortion was considered a crime under the penal law of India, barring certain exceptions. As a result, women often resorted to illegal abortions at the hands of unskilled and unqualified persons. Abortion has subsequently been legalized with the enactment of the Medical Termination of Pregnancy Act, 1971. The author has incorporated recent case law at the relevant places. The Appendices provide the text of the statutes on the subject.
The book will be indispensable to the lawyers, and the medical profession. In addition, the work will be a useful guide to all those who have litigation on these subjects pending before the courts.
