Legal Aid to Your Aid

The Preamble of the Indian Constitution clearly aims to secure justice—social, economic,  and political—for the people of India, emphasizing the importance of the rule of law. Key provisions, such as Articles 38 and 39-A, play a crucial role in this context. Article 38 directs the State to promote the welfare of its people by ensuring and protecting social order, including justice. Meanwhile, Article 39-A mandates that the State provide free legal aid through appropriate legislation or schemes to guarantee that no citizen is denied the opportunity to secure justice. Thus, free legal aid for the poor and underprivileged is considered a vital component of upholding the rule of law. Legal aid is designed to provide free legal assistance to those who are unable to assert their rights through judicial, quasijudicial, or other authorities. Justice P.N. Bhagwati described legal aid as a system that makes the machinery of justice accessible to those who need it to enforce their legal rights.
