Overview:

This authoritative work of about 500 pages contains the full text of the Mandal Commission case (which consisted of 910 typed pages) alongwith an analytical, detailed and expert headnote.

The book will be of great interest not only to lawyers but also to social scientists, who are vitally concerned with the identification of 'backward classes ' and their representation in the State employment sector at all levels. The chief merit of the book is its good headnotes which have been divided into separate subheadings indicating what each of the nine Judges has said under the different subject headings. The system of headnoting provides easy and quick access to the required passage. The volume also contains analytical notes which provide cross referencing and information on other cases on the same subject.

Reviews

  • Academy Law Review : The book under review is the text of the judgment. Apart from providing the text of the judgment, the book contains the facts, issues and opinions deduced from the judgment. The other noteworthy aspects are the editorial short notes, annotations and cross-references. These give a clear understanding of the issues involved, and the views of the different judges. The table of cases, and bibliography of books and articles referred to in the judgment enhance its value as a reference book rather than a mere compilation of the judgment. The Editor, by this work, has proved beyond doubt that matters involving complicated issues can be codified in a lucid and more digestible manner. The book, no doubt, will be valuable to sociologists, politicians and others who are interested in the subject.
  • Administrator: The book, on the whole, has succeeded in projecting the Mandal issues and the decisions of the Supreme Court thereon. Hence, all persons interested therein, whether they are advocates, academician, activists, judges, sociologists or common people, will find it quite informative, instructive and useful.
  • The Hindu: Surendra Malik has done great service to those concerned with the Mandal campaign, whether for or against. Here Surendra Malik does service to the rule of law by giving meaningful headnotes with the background of facts leading up to the case and brief comments elucidating obscurities which befall the long opinions of the Court. Certainly, Malik has done a marvellous job of condensation without sacrificing accuracy and stress on the crucial aspects of the pronouncements. Indeed, it is a tribute to the publisher to say that on reading of the head-notes, which run into over 60 pages, nothing in the judgments is missed if one carefully peruses the headnotes alone.
  • Lawyer 's Collective: This book is sure to be on the shelf of every lawyer concerned with the subject and in all libraries of academic institutions. It is a well produced, well priced volume which will be required for a long time to come.
  • Gujarat Law Reporter: The alphabetical subject index given at the end indicates the various issues decided by the case. This book will be useful to those who are interested in the subject.
