Overview:

The Constitution of Empire of Japan of 1889 (commonly called the "Meiji Constitution", after the emperor during whose reign it was composed), was the fundamental law of the former state. Enacted after the Meiji Restoration in 1868, it provided for a form of mixed constitutional and absolute monarchy, based jointly on the Prussian and British models.In theory, the Emperor of Japan or Tenno was the supreme ruler, and the Cabinet, whose Prime Minister would be elected by a Privy Council, were his followers; in practice, the Emperor was head of state but the Prime Minister was the actual head of government.

Under the Meiji Constitution, the Prime Minister and his Cabinet were not necessarily chosen from the elected members of the Diet. Pursuing the regular amending procedure of the "Meiji Constitution", it was entirely revised to become the "Postwar Constitution" on 3 November 1946. The Postwar Constitution has been in force since 3 May 1947.

The Meiji Constitution established clear limits on the power of the executive branch and the Emperor. It also created an independent judiciary. Civil rights and civil liberties were guaranteed, though in many cases they were subject to limitation by law. However, it was ambiguous in wording, and in many places self-contradictory. The leaders of the government and the political parties were left with the task of interpretation as to whether the Meiji Constitution could be used to justify authoritarian or liberal-democratic rule.
