Supreme Court on Human Rights and Civil Rights and Political, Social, Individual and Economic Rights (1950 to 2018) (in 2 Volumes)

This two volume comprehensive and exhaustive Digest on the important subject of Human and Civil, Political, Social, Individual and Economic Rights, is a complete source for the entire case-law on the subject, from 1950 to 2018 as laid down by the Supreme Court.

The issue of “human rights” is a highly contentious philosophical issue. The landmark judgment by the nine-Judge Bench in Puttaswamy, (2017) 10 SCC 1, has finally settled the issue of Human Rights as a matter of law in India i.e. what falls under the head of human rights are inherent rights.

The rulings on the subject have been painstakingly extracted by the authors from many diverse areas of law. A key feature of this work is that all important rights have been arranged using a topic approach for e.g. the reader can straightaway find the “Right to Dignity”, or the “Right to Privacy”, or “Right to Information, Confidential Information and Data Protection”, and of course all other important rights in the same manner by studying the Bird’s Eye View at pp. I-9 to I-10 of Vol. 1. Not only are the headings properly placed under both topic and statutory headings, they are interconnected by a well-planned cross-reference system supported by synopses.

A very useful feature of this print Digest is that since digest notes on the same or similar points are naturally placed close to each other, by locating the digest notes on any known case from the Table of Cases Digested, other relevant rulings on that point can easily be located nearby.

Also, cross-citation, annotations, editorial notes and comments are included in the digest.

This systematic, analytical and comprehensive two volumes digest will be of immense use for the judiciary, wide range of legal professionals and members of the Bench.

Volume 1 covers Generally to Right to Freedom of Speech and Expression to Assemble and Protest, etc.

Volume 2 covers Right to information, Confidential Information and Data Protection to End.

Law and Social Transformation

Law and Social Transformation, a classic treatise by Dr. P. Ishwara Bhat expertly puts forward optimistic signs of the Indian legal system’s competence to both lead and follow social transformation with an admirable commitment to multiculturalism, empowerment, and sober modernism.

The work is divided into four parts. Part I is a jurisprudential journey of India’s evolution as a rule of law country struggling to build a social order informed by equity, equality, and justice. Part II deals with Religion, Language, Regionalism, and Ethnicity. Part III is devoted to an incisive study of the interaction between law and the Constitution on the one hand and the weaker section of society (women, children, and backward classes) on the other. Part IV is a bold attempt to look at the role of law vis-à-vis several sectors of the polity, the economy, the justice delivery system, and the civil society in the context of modernization and globalization.

This new edition is a method of understanding the working of the Constitution in society in its complexity and dynamism. It is a study of transformative constitutionalism in the day-to-day legal system. The author has included all the recent developments and case laws to date along with a new chapter on the social dimension of law during the pandemics (COVID-19).

This work is sure to inspire further thinking about law and society’s active partnership in social transformation. The book will benefit students and teachers of law and sociology, lawyers, judges, legislators, social activists, NGOs, administrators, policymakers in the government, and the general public of the country.
