Overview:

In a given situation when laws are found to be inadequate for the purposes of grant of relief, the Court can exercise it jurisdiction under Article 142 of the Constitution. The directions issued by the Court under Article 142 form the law of the land in the absence of any substantive law covering that field. Such directions, fill the vacuum` until the Legislature enacts substantive law. In many areas the Supreme Court filled the legislative vacuum by Judicial Legislation. Many of the institutions like Central Vigilance Commission (Vineet Narain case), Commission for Backward Classes (Mandal case), Police Complaint Authority (Prakash Singh case), Armed Forces Grievances Redressal Commission (Pushpa Vanti Case) were formed by the Government pursuant to Directions from the Apex Court.
