The Bharatiya Nyaya Sanhita, 2023 repeals the Indian Penal Code, 1860 (45 of 1860) to streamline provisions relating to offences and penalties. The Bharatiya Nyaya Sanhita, 2023 replaces the Indian Penal Code, 1860 (IPC), which was the principal law on criminal offences. It introduces community service as a punishment for petty offences for the first time. Offences against women and children, murder, and offences against the State have been given precedence.
To address the challenges of organised crimes and terrorist activities, new offences such as terrorist acts and organised crime have been added with stringent punishments. Additionally, a new offence covering acts of secession, armed rebellion, subversive activities, separatist activities, or actions endangering the sovereignty, unity, and integrity of India has been incorporated. The fines and punishments for various offences have also been suitably enhanced.
