Supreme Court on International Law

This one-volume detailed Digest on the subject of International Law is a complementary source for the entire case-law on the subject, from 1950 till date* as laid down by the Supreme Court. A great deal of the subject matter covered under International Law overlaps with the case law digested in Supreme Court on Human and Civil Rights -- the two works are complementary in nature.

The Digest has been conceived and planned on the time-tested SCC index system to enable the discovery of all the rulings, easily and quickly. Case-law has been digested under important topic headings like Principles, Concepts, and Doctrines; Law of Treaties/Agreements/Conventions; International Law vis-à-vis Municipal Law; Conflict of Laws/Law Related to Aliens/Foreign Nationals/Private International Law; International Criminal Law; International Environmental Law; International Humanitarian Law; Legal Framework on Intellectual Property Rights; Maritime Laws/Law of the Sea; International Trade and Tax Law; and forty-nine important governing Statutes/Conventions/Treaties/Agreements, etc.

The rulings have been arranged under both topic and statutory headings, interconnected by a well-planned cross-reference system supported by synopsis wherever necessary to make research of relevant rulings convenient.  Another very useful feature of this Digest is that since digest notes on the same or similar points are naturally placed close to each other, by locating the digest notes on any known case from the Table of Cases Digested, other relevant rulings on that point can easily be located nearby. The regular features like cross-citations, annotations, Coram details, editorial notes, and comments also continue.

International Law And Human Rights

The present edition has been thoroughly revised, updated and vastly enlarged. The author has added fresh material on old topics. The comprehensive coverage expands the view point of the reader and stimulates to think critically.

The revised edition provides leading cases on the subject as specified in the syllabus alongwith recent decisions of National and International courts. The work discusses recent issues like Rohingya Muslims, UN, Declaration on Child Rights,Rights of Persons with Disabilities, and Rights of Ageing Peoples, Sabarimala judgment, Right to Privacy (Aadhaar), Decriminalisation of adultery, LGBT rights, etc.

International Law and Human Rights by K.C. Joshi is the most comprehensive textbook on the subject. In its 4th edition, the book is thoroughly revised with the latest syllabus. Three new chapters on Human Rights and Humanitarian Law, Social Inclusion of Human Rights and Global Alliance of National Human Rights Institutions (GANHRI) have been added.

In Human Rights section of the book, provisions with respect to Rights of Persons with Disabilities Act, 2016, Whistle Blowers Protection Act, 2011 (17 of 2014) and Juvenile Justice (Care and Protection of Children) Act, 2015 have been added at appropriate places. Reference has also been made to path-breaking decisions of the Supreme Court of India with reference to human rights, e.g. Sabarimala judgment, right to privacy (Aadhaar), decriminalisation of adultery, LGBT rights among others.

In International Law part of the book, the Chilcot Report on United Kingdom’s Military Action in Iraq War (2003) and surgical operation by India are included. The Treaty on the Prohibition of Nuclear Weapons, 2017 is a pious wish of international community and finds place in this edition of the book. Environment continues to be a grave concern of international community and adoption of legally binding Paris Agreement, 2016 is a major achievement. This treaty has been discussed in the book.
