The Protection of Women from Domestic Violence Act 2005 has come into force recently. It is in this context that we at the Lawyers Collective felt that there was a need to bring out the Second Edition of the "Law of Domestic Violence". This edition of the Manual has been specifically intended to act as a guide to understanding the new law on domestic violence. At the same time, it provides a clear and simple introduction not only to the newly enacted legislation but also to the other existing laws relating to domestic violence, and draws upon the practical experience of The Lawyers Collective to suggest creative ways in which they can be used."Law of Domestic Violence" attempts to provide an understanding of the provisions of the new law, the role of the key implementing agencies under the Act as well as procedures through which the courts can be approached. The Manual has been written in a simple and user-friendly manner, and does not requie a legal background to be read and used. "Law of Domestic Violence" has something in it for everyone: people who don’t have a legal background or new to this issue will learn what the law is all about and how it works; lawyers and law students will find relevant case law and suggestions for strategy; and NGOs and other service providers will understand how the law can help their clients. If you are facing Domestic Violence or know somebody who is, this Manual will tell you what your legal rights and remedies are, and help you use them innovatively and effectively.Special Features include:Detailed look at the provisions of the newly enacted Protection of Women from Domestic Violence Act 2005 and how this law can be used.Overview of the Judicial system and guide to legal procedure.Comprehensive coverage of issues in civil law, including divorce, maintenance, property rights, and guardianship.Comprehensive converge of issues in criminal law, including dowry death, cruelty, and injunctions.Detailed treatment of different personal laws.Discussion of non-legal remedies for Domestic Violence, and a list of NGOs dealing with the issue.Extensive glossary.*code 402
