Dr. Nand Lal's Commentary on the Code of Civil Procedure was justly regarded by the Bench and the Bar throughout Indian Sub-Continent as a classic. It was easily distinguishable from commentaries which were merely digest of case law.
The procedure is the backbone of the whole Judicial system, and the importance of the Code of Civil Procedure cannot be overrated. It is a pivot around which revolves the entire judicial machinery. The whole policy of procedural law as to see that every Civil Case has a fair trial.
The Code of Civil procedure plays an important role in achieving the object of the underlying principle which is essential so that there may be a fair trial and no lacunae are left in the procedure, as laid down and developed through case law.
When the work was originally planned, it was intended to be an exhaustive review of the law on the subject. As such all the reported and unreported cases were pressed into service for this purpose. Although in the revisionm, the original approved scheme has been sacredly followed and preserved but have noth over burdened the book by adding any and every authority since with the multiplication of Law Reports in the last few years and apparently the competition between them of reporting largest number of cases has enormously increased, the bulk of case law without correspondingly shedding more light on the subject by selected reporting.
It is hoped that this abridged idition will be found every useful in the day-to-day working by the Bench and the Bar and students of law,alike.
