The Law Society has granted her the Higher Courts Civil Proceedings Qualification, and she is authorized to exercise the rights of audience in the High Court in all proceedings and in all civil proceedings in other courts. Ms. Nairn serves as vice president of the ICC International Court of Arbitration in Paris and is also a member of the ICC Commission on Arbitration. She is regularly appointed as counsel or arbitrator in complex international commercial disputes in cases conducted under the auspices of the leading international arbitral institutions such as the LCIA, ICC, SCC, ZCC, AAA and ICSID. Ms. Nairn advises on private and public international law issues in both arbitration and litigation cases. Patrick HeneghanPatrick Heneghan is a partner focusing on international arbitration, cross-border commercial litigation and other dispute resolution procedures. Mr. Heneghan has extensive experience acting for clients as counsel in high-value commercial international arbitrations as well as in investment treaty proceedings. He has represented clients in international arbitration proceedings under a variety of different rules, including ICC, LCIA, ICDR and UNCITRAL, and seated in numerous jurisdictions including London, Hong Kong, Paris, Geneva, Stockholm and Johannesburg. These disputes cover a broad range of commercial matters, including disputes arising out of shareholder agreements and commercial contracts, as well as disputes relating to telecommunications, oil and gas, mining, insurance, finance and banking, pharmaceutical products and infrastructure, engineering and energy projects. Mr. Heneghan also has extensive experience of managing large-scale commercial litigation in multiple fora and venues, including the High Court in London, offshore jurisdictions (including in the Caribbean, Cyprus and the Channel Islands), Russia, the Middle East and Africa. These proceedings have involved obtaining interim and final injunctive relief, anti-suit injunctions, pre- and post-judgment freezing orders, security for costs, charging orders and other enforcement relief. Mr. Heneghan’s cross-border litigation experience also includes advising clients in respect of stand-alone and follow-on claims for breach of EU and U.K. competition law. Mr. Heneghan has authored various articles in international arbitration, expert determination, competition law and other related fields. He is acknowledged by The American Lawyer as having participated in one of the highest value international arbitrations of recent years, and is recognised in The Legal 5 UK (211) as being a key individual in international arbitration, where he is praised by clients for “achieving results.”
