Portuguese Civil Code, 1867 (The Goa Succession Special Notaries and Inventory Proceeding Act, 2012) (Laws of Marriage, Divorce and Children)

As you are aware the State of Goa is the only State in the country already having a Uniform Civil Code since 1870.

Peacefully followed and accepted by all people, covering Civil Capacity/ Obligations (Contracts), Marriage, Divorce, Children, Succession, Property and Civil Wrongs.

Many matters relating to the need for Uniform Civil Code as well as matters specifically arising from Goa come up before the Supreme Court.

Any study or research on the subject Uniform Civil Code should necessarily mean a study of the Portuguese Civil Code in Goa, which is after all being in successful operation for 150 years.

There was no translation of the Civil Code since Liberation of Goa in 1961.

The first full translation alongwith full commentaries and case law was done by the undersigned in January, 2016. It has been used by Hon'ble Supreme Court and Bombay High Court. Now the second edition has been released.

Government of Goa engaged the services of the undersigned to effect the official translation or the Portuguese Civil Code, 1007 and Portuguese Code of Civil Procedure, 1939, pursuant to instructions of the High Court in P.I.L. No. 01/2017 and in view of Art.348 of the Constitution. Both are completed and gazetted.

The present book was released It the Hon'ble Chief Justice of Bombay High Court and has a foreword by the Hon'ble NI, Justice M.S. Sonak.

It has up-to-date case law and comments from noted jurists including latest Supreme Court judgement dated 13/09/2019.

Being the only statute inforce in the nature of Uniform Civil Code, it would be of great interest to any studious lawyer.

The book answers to the requirements of Research Scholars, students, Parliamentarians and Government Officers. All interested in the Uniform Civil Code ought to have a copy of the same with them for ready reference.
