A judgment is a formal expression of adjudication and it should be one which ought not to be left open what is exactly adjudicated upon. A judicial in nature and should not depart from sobriety, moderation and reserve.
The art of judgment writing is to developed by the members of judiciary if, a judgment which is based on materials not in evidence or which have been improperly admitted or on personal knowledge of the Judge cannot be said to be in accordance with the law.
To make the evaluation work more skillful, the help of the contentions and examinations conducted by the Advocates should be discussed. Before making any clear order to the parties, the reasons with the help of decided facts in issue and the law applicable and its interpretation should be recited.
In this book, the essential parts of a judgment have been dealt, with the help of the pronouncements made by the Courts in India and England. The Book has been divided in several chapters for easty reference. An endeavour has been not only to provide the tools to the new judicial officers to skilfully express their decisions, but also for the senior members of the judiciary to enrich their art of writing judgments.
The art or skill of writing a judgment could be achieved by constant improvement in this technique, and this is for what, this book is aimed at.
