Overview:

Tobi's Criminal Procedure and Evidence in Nigeria : Synopsis of Supreme Court Judgments, is a follow up study of Sir Vahe Bairamian's work on the same subject-matter. The author takes off from where Sir Vahe stopped. Although the study is designed to cover the period 1967-1977, the author has understandably moved out of the period in his analysis of the different topics. He has dealt at some considerable length on the Constitutional impact on the rules of criminal procedure and evidence. The unique aspect of this work is that it deals with both the Criminal Procedure Act and the Criminal Procedure Code. Apart from its sister volume, there is no work on a Nigerian law which deals with the two codes. As the work was completed before the enactment of the Constitution of the Federal Republic of Nigeria, 1979, the author is unable to incorporate the relevant provisions. He however adds as an appendix to the book the provisions of Section 33 of the Constitution which the reader will find as a useful cross-reference to the provisions of the 1963 Constitution analysed in the book. The book will, no doubt, be of considerable help to members of the bench, the bar and the law students.
